“Please kindly read these TERMS AND CONDITIONS before booking your trips. Participation in our trips indicates that you accept these terms and conditions.

 

HOLIDAY CONTRACT

In these terms and conditions, “we”, “our”, “us” or “company” means TOUR EXPERTS PVT. LTD. When you make a booking and we accept it, a legally binding contract is made. When you sign or fill online booking form, you (and any other person on whose behalf you book) agree to accept all of these conditions; you acknowledge that you have read the Relevant Trip Document and the General Information.

The person making the booking (the ‘lead name’) must be 18 years old or over and possess the legal capacity and authority to make the booking and accepts these booking conditions on behalf of everyone in their party. You also warrant that the information given by you on the booking form is complete and true. Texts are copyright to www.tourexperts.com.np. A contract will exist as soon as we issue our confirmation invoice.

*Note that we will not issue a confirmation invoice, and therefore no contract will exist, until we receive a fully-completed booking form for each and every member of any party. The services to be provided are those referred to in your booking confirmation invoice.

This contract is made on the terms of these booking conditions; any disputes arising from this contract are to be decided by the courts of the Federal Democratic Republic of Nepal.

 

BOOKING, CONFIRMATION AND PAYMENT

To secure a booking the Company must receive payment of the minimum deposit of 10% of the total trip price, per person or in the case of bookings made within 45 days of departure, the full trip price. Texts are copyright to www.tourexperts.com.np. For certain treks, full payment must be received at an earlier stage before the start of your tour. You will be advised at the time of booking when this is the case. We will then send you a written confirmation of the booking. It is at this point that a contract between the Company and the client comes into existence which will be governed by the laws of the Federal Democratic Republic of Nepal and subject to the exclusive jurisdiction of the courts of the Federal Democratic Republic of Nepal.

The balance of the trip must be paid not later than 45 days prior to departure and if not received on time, the Company reserves the right to treat the booking as cancelled and cancellation charges will apply. Please note that all payments to TOUR EXPERTS made on a credit card (whether deposits, part payments or final balances) will be subject to a levy of 2.25 to 4%. We reserve the right to increase this charge if the card issuer’s charges to us increase

 

IF YOU CHANGE YOUR BOOKING

If, after our confirmation has been issued, you request a change in the dates or content of your itinerary we will do our best to meet your requirements and reserve the right to charge an alternation fee of 2% of the trip price to cover our administration costs. Any request for changes must be made in writing from the person who made the booking or your travel agent. You should be aware that any such request received within 45 days before departure will be treated as a cancellation and re-booking and thus subject to cancellation charges.

 

IF YOU CANCEL YOUR HOLIDAY

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking or your travel agent on your behalf must be received at our office. Depending on when notification of cancellation is received, cancellation charges will be applied as follows:

If your reason for cancellation is because of events beyond your control you may transfer your booking to another party provided that you give us reasonable notice to make such arrangements and that you and the transferee agree to be jointly and severally liable for any outstanding payment under the contract.

Note: Certain travel arrangements (e.g.  Pre-paid services for flights, transports, National Park Entrance Frees, Hotel Accommodations) cannot be refunded or changed after a reservation has been made and any alteration request will incur a 100% cancellation charge.

 

IF WE CHANGE OR CANCEL YOUR HOLIDAY

Once, after our confirmation has been issued, the Company will do its best to operate all the trips as advertised but reserve the right to cancel your booking or change any of the facilities, services, prices or itineraries described in our brochures or website. It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. It is a necessary condition of your joining any of our advertised holidays that you accept this flexibility. Most of these changes will be minor (including change of schedules in domestic flights, change in accommodation in similar standard hotels/lodges, local land transfers etc.) and reserve the right to alter or cancel the whole or part of the trip if we cannot avoid doing so. Reasons for doing so would include Force Majeure such matters as war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances.  If any such alternations are significant then you will have the right to cancel the holiday when we will refund in full all monies paid as we will do in the event of cancellation by us. In either event we will do our best to provide you with comparable alternation arrangements which may be a different price but if they are not acceptable to you then, if appropriate, we will pay you compensation up to a maximum of 2% of the holiday price.

 

PRICES AND INCREASES

All prices of any of the holidays shown in our brochure and/or on our website are accurate at the date published, since prices on our website are updated regularly but we reserve the right to change any of those prices. Before you make your booking, you will be advised of the current price of your chosen holiday including any upgrades or additional facilities which you have requested.

Price increases and surcharges of your travel arrangements will be calculated accordingly to the full extra cost compared to the costs and exchange rates obtained in our brochure and/or on our website. Foreign currencies will be calculated using exchange rates quoted on Nepal Rastra Bank. Changes in transportation costs, including the cost of fuel and domestic airfares, dues, taxes or fees chargeable for services or adverse exchange rate variation mean that the price of your travel arrangements may change after you have booked.

We will absorb any such price increases up to an equivalent of 2% of the holiday price, which excludes any amendment charges, but if the necessary price increases exceed that level then we will notify you accordingly and reserve the right to charge you that extra amount up to a maximum of 10% at which level you will have the right to cancel the holiday within 14 days of such notification with full refund of all monies paid, except for any amendment charges or we will have the right to charge you such excess over 10% of the holiday price. Notwithstanding the provisions of this clause the trip price will not be increased within 30 days of departure.

 

OUR RESPONSIBILITIES

If you are unhappy during your holiday, you must inform your tour leader who will endeavor to put things right. If your complaint is not resolved locally, please follow this up within 15 days of your return home by writing to us at Tour Experts Pvt. Ltd. giving your booking reference and all relevant information. Please keep your letter concise and to the point. Failure by you to complain at such earliest opportunities may prejudice your legal rights. Giving your booking reference and all relevant information. YOUR RESPONSIBILITIES

It is your responsibility that passports (with at least 6 months validity beyond the date of your return), visas, vaccination certificates, and other necessary travel documents are in order and we reserve the right to charge you any costs incurred by us due to your failure in any of these respects.

It is a condition of your contract with us that you act with reasonable prudence and circumspection whilst on holiday accepting the authority and decisions of the Company’s employees, tour leaders and agents and that you comply with all health and safety requirements of guides, camps and the like or happy progress of the tour.

It is also your responsibility to check in for your flights by the correct time and to be in the right place at the right time for ground travel arrangements.  We do not accept liabilities if you fail to do so and no credits or refunds will be given for lost or mislaid air tickets or other travel documents.

As between you and suppliers of accommodation, transport and other services which form part of your holiday their conditions of business will apply which may mean that you will be required by such suppliers to sign liability waivers or other documentation for some potentially more hazardous activities such as walking, hiking, trekking, jungle safaris, rafting and expeditions.

If you are unable, or choose not to complete an itinerary outlined for a holiday, Tour Experts is not liable to supply alternative itineraries, excursions, accommodations, services or staff for the period when the client is not present with the group.

 

INSURANCE

You are strongly recommended to take out personal liability, personal accident, medical expenses and cancellation insurance at the time of booking our holiday. If, in the event of an emergency medical rescue or evacuation from a trip of you the client, either by foot, helicopter or otherwise the responsibility for the payment of such costs will lie with the client. Any subsequent costs incurred for expenses such as hotels, food, transport etc shall be borne by the client.

It is imperative that the client ensures adequate insurance cover is in place before departure. It is your responsibility to ensure that the insurance cover you purchase is adequate for the particular needs of you and your party.

  • We do not check insurance policies.
  • We reserve the right to cancel your booking at any time before departure if we are not satisfied that adequate insurance is in place for you.

 

PHOTOGRAPHY AND TESTIMONIALS

Any likeness or image of you secured or taken on any of our holidays may be used by the Company without charge in all media (whether now existing or in the future invented) for bonafide promotional or marketing purposes, including without limitation promotional materials of any kind such as brochures, slides, video shows or the internet. Any written feedback supplied to the company may also be used for promotional purposes as detailed above. Program members who prefer that their images not be used are asked to identify themselves to their Tour Director at the beginning of their program.

 

PRIVACY

All your personal information or document we have received will be for our internal use only such as for permits, booking etc. We shall not use any of your personal information for our business purpose or we shall provide any personal information third parties. We shall keep your all personal information secured.
